Item 8.01 Other Events
On November 15, 2005, UTC Power, LLC (“UTCP”) filed a notice of dismissal without prejudice
with respect to the lawsuit that UTCP filed on September 16, 2005 in the United States District
Court for the District of Connecticut, whereby UTCP sought to enjoin Capstone Turbine Corporation
(“Capstone”) from terminating or attempting to terminate the OEM Agreement between UTCP and
Capstone. On November 16, 2005, the United States District Court for the District of Connecticut
entered an order dismissing the case.
